Welcome to Niblo! These Terms of Service ("Terms") govern your use of the Niblo mobile application ("App") and related services provided by Niblo ("we," "our," or "us"). By using Niblo, you agree to these Terms.

1. Acceptance of Terms

By creating an account or using Niblo, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use our App.

2. Description of Service

Niblo is an AI-powered nutrition tracking application that helps you:

• Log and track meals through text, voice, or photos
• Receive AI-generated nutritional analysis and insights
• Track water intake and health goals
• Chat with an AI assistant about nutrition topics
• View personalized insights and patterns

3. Account Registration

3.1 Eligibility

You must be at least 13 years old to use Niblo. By using our App, you represent that you meet this requirement.

3.2 Account Security

You are responsible for:

• Providing accurate and complete registration information
• Maintaining the confidentiality of your password
• All activities that occur under your account
• Notifying us immediately of any unauthorized access

3.3 One Account Per Person

Each user may maintain only one account. We reserve the right to terminate duplicate accounts.

4. AI-Generated Content Disclaimer

You acknowledge and agree that:

• Nutritional estimates provided by our AI are approximations and may not be completely accurate
• Our AI assistant provides general guidance, not personalized medical or dietary advice
• You should consult with qualified healthcare professionals before making significant dietary changes
• You should not rely solely on Niblo for managing any health condition
• AI-generated content may contain errors or inaccuracies

5. Acceptable Use

You agree NOT to:

• Use the App for any illegal purpose
• Upload harmful, offensive, or inappropriate content
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the App's functionality
• Use automated systems or bots to access the App
• Reverse engineer, decompile, or disassemble the App
• Share your account credentials with others
• Use the App to harm or harass others
• Upload content that infringes on others' intellectual property rights

6. User Content

6.1 Your Content

You retain ownership of content you submit to Niblo (photos, meal descriptions, etc.). By submitting content, you grant us a license to use, process, and analyze it to provide our services.

6.2 Content Guidelines

You are responsible for ensuring your content:

• Does not violate any laws or regulations
• Does not infringe on others' rights
• Is appropriate and relevant to nutrition tracking

7. Intellectual Property

The Niblo App, including its design, features, content, and underlying technology, is owned by us and protected by intellectual property laws. You may not:

• Copy, modify, or distribute our App or content
• Use our trademarks without permission
• Create derivative works based on our App

8. Subscription & Payments

8.1 Free Tier

Niblo offers a free tier with limited features. No payment is required for the free tier.

8.2 Premium Subscriptions

If you purchase a premium subscription:

• Payment will be charged to your Apple ID account at confirmation of purchase
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
• You can manage and cancel subscriptions in your App Store account settings
• Refunds are handled by Apple according to their refund policy

9. Termination

9.1 By You

You may stop using Niblo at any time. You can delete your account through the App (Profile → Delete Account), which will permanently remove all your data.

9.2 By Us

We reserve the right to suspend or terminate your account if you:

• Violate these Terms
• Engage in fraudulent or illegal activity
• Abuse our services or other users

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• NIBLO IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND
• WE DO NOT GUARANTEE THE ACCURACY OF NUTRITIONAL INFORMATION OR AI-GENERATED CONTENT
• WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES
• OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS
• WE ARE NOT RESPONSIBLE FOR ANY HEALTH DECISIONS MADE BASED ON APP INFORMATION

11. Indemnification

You agree to indemnify and hold harmless Niblo and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the App or violation of these Terms.

12. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by:

• Posting updated Terms in the App
• Updating the "Last Updated" date
• Sending you a notification for significant changes

Continued use of Niblo after changes constitutes acceptance of the new Terms.

13. Dispute Resolution

13.1 Informal Resolution

Before filing any formal complaint, you agree to contact us first to attempt to resolve any dispute informally.

13.2 Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Niblo regarding use of the App.

16. No Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

17. Third-Party Services

Our App may contain links to or integrate with third-party services. We are not responsible for the content, privacy policies, or practices of third-party services.

18. Feedback

If you provide feedback or suggestions about Niblo, you grant us the right to use that feedback without any obligation to you.
